1 Object
1.1 These Terms and Conditions of Sale (hereinafter, Terms and Conditions) govern the purchase of Products, made remotely, via telematic network, from the website www.helixfarmita.it (hereinafter, the Site) by adult users (hereinafter, Customers).
1.2 The owner of the Site is Perniciaro Maria Cristina, owner of Helixfarmita with registered office in C.da Terrenove – 91026 Mazara del Vallo (TP). Tax Code and VAT No.: 02275780811 ; Email: info@helixfarmita.it
2 Acceptance of the general conditions of sale
2.1 All purchases of Products made through the Site (hereinafter, the Purchase Contracts) by Customers who access it are governed by these Terms and Conditions as well as by the Italian Consumer Code (Legislative Decree no. 206/2005), Section II – Distance Contracts (art. 50 – 67) and by the Italian regulations on electronic commerce (Legislative Decree 70/2003).
2.2 With the conclusion of the Purchase Agreements, according to the procedure, the Customer accepts and undertakes to observe these Terms and Conditions.
2.3 The Customer, therefore, is required to carefully read these Terms and Conditions before making any purchase, which Helixfarmita makes available also in order to allow reproduction and storage in compliance with the provisions of art. 12, paragraph 3 of Legislative Decree 70/2003.
2.4 Helixfarmita may modify, supplement, and update the content of the Terms and Conditions at any time and without notice. Each individual Purchase Agreement will be subject to the Terms and Conditions published on the Site at the time the purchase order is submitted by the Customer.
3 Products
3.1 The website www.helixfarmita.it is an online site for the sale of products from our farm (hereinafter, "Products").
3.2 All the Products offered are detailed on the Site, within the section called Shop.
3.3 The visual representation of the Products on the Site, where available, is indicative and is solely intended to present them for sale.
4 Purchase procedure
5.1 The Customer can purchase the Products available on the site from the section called "shop".
5.2 To purchase the Products, the Customer must first contact the company by email or telephone (see the "Contacts" section) to order the "extra virgin olive oil" product, in order to ensure its actual availability.
After booking, the customer will receive a confirmation email regarding availability, after which they can make a purchase from the shop section of the website.
5.3 The Customer must select the Products of their interest, which will be added to the "Cart" section of the Site, and may proceed with the purchase. The Customer can perform this operation at any time, it being understood that the products will be shipped from Monday to Saturday. The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate "Shipping Address" field. All purchases will be delivered by a courier appointed by the Company.
5.4 Once this operation is completed, the Customer will see a screen containing a summary of the purchase order, including the shipping details, with a request to confirm the purchase procedure.
5.5 Before submitting the order, if the Customer needs to modify all or part of the Products to be purchased or to change some of the data contained therein, they must follow the appropriate modification procedure on the Site by accessing the Cart section. In particular, the Customer will have the option to change the quantity of Products they intend to purchase, by adding or removing one or more Products from the Shopping Cart.
5.6 After the order has been sent, it is no longer possible for the Customer to modify its content.
5.7 The customer will receive an email confirming the order placed.
5.8 The product will be shipped only when payment has been made.
6 Conclusion of the contract
6.1 The publication of the Products displayed on the Site constitutes an invitation to the Customer to make a contractual purchase offer. The order sent by the Customer constitutes a contractual offer and implies full knowledge and complete acceptance of these Terms and Conditions.
6.2 Each Purchase Contract entered into between Helixfarmita and the Customer shall be considered concluded upon Helixfarmita sending the order acceptance to the Customer's email address. This confirmation message will indicate an "Order Number," to be used in all subsequent communications with Helixfarmita. The message will reiterate, in addition to the information required by law, all the data entered by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections. Any additional costs resulting from errors in the data not promptly reported will be borne exclusively by the Customer.
7 Product Prices
7.1 The prices of the Products indicated on the Site are excluding VAT.
7.2 The price of the oil refers to the liter.
8 Invoicing and payment methods
8.1 Helixfarmita issues an accounting document relating to the Products purchased, at the moment the Products are delivered to the Customer, sending it, where expressly requested, by e-mail to the Customer within 3 days from delivery. The information provided by the Customer is used for the issuance of the accounting document. No changes to the data will be possible after the issuance of the accounting document.
8.2 Payment for the Products purchased is made by advance bank transfer before delivery or by credit/debit cards through online payment systems such as Paypal.
9 Methods of Product Delivery
9.1 Helixfarmita uses secure packaging for deliveries that guarantees the integrity of the product. The transport is entrusted to couriers that we have selected and who assume full responsibility for the delivery.
9.1 Once the order has been placed, it will no longer be possible to change the shipping address. It is recommended to check the shipping address entered before submitting the order by accessing the reserved area on the website in the profile data.
9.2 At the time of collection of the Products, the Customer is required to carefully check that the boxes containing the Products are intact and not damaged or otherwise altered. Any damage to the packaging and Products must be immediately contested by the Customer and reported to Helixfarmita.
9.3 Helixfarmita assumes no responsibility for the poor condition of the Products due to improper storage after collection by the Customer.
10 Discount Coupons / Promotions
10.1 Any discount vouchers or promotional codes may be entered by the Customer when completing the purchase order. The system will update the total amount of the order net of the value of the voucher.
10.2 REGULATIONS AND REQUIREMENTS FIDELITY CARD
Loyalty campaigns often provide a reward for the customer who joins the campaign. These types of operations are called "Prize Operations" and are regulated by D.P.R 430/2001. Articles 3 and 6 specify which operations qualify as prize operations and which are excluded.
From what is stated in the aforementioned articles, it is clear that a "Points Collection" campaign that entitles the participant to receive a prize free of charge, after documenting (points) a certain amount of purchases/spending, certainly falls within those regulated by the aforementioned D.P.R. 430.
10.3 The discount voucher may be combined with other commercial initiatives only in cases where this is expressly indicated.

13. Personal data
13.1 Customer data is processed by Helixfarmita in accordance with the provisions of the
